Estate Planning, Wills, & Trusts

Picture
Our attorneys carefully consider the needs and goals of each client in preparing every estate plan. We provide comprehensive, tax-sensitive estate planning documents individually tailored to each client. The importance of Estate Planning is to ensure that your health, personal care, property and assets are taken care of according to your wishes. As part of the estate planning process Mary may prepare for you:
  • Wills, including Pour-Over Wills, which are Wills which work in unison with a Revocable Living Trust
  • Revocable Living Trusts
  • Financial Durable Powers of Attorney
  • Health Care Powers of Attorney
A Will determines how your property is distributed, stipulates who will care for your minor children, and allows you the control of who will receive your assets and property. A Trust allows your beneficiaries to receive the most value from your Estate, while also offering added tax benefits. Allow us to work with you in preparing your Will and establishing your Trust.
Estate | Probate Administration

When a loved one passes away, their Estate must be examined, inventoried, and properly managed. We have the knowledge and expertise to effectively handle the administration of estates of any size. From simple estates to large and complex estates, including estates involving significant wealth, interests in ongoing businesses, and assets located in multiple states, every estate is a priority. We can assist you throughout the entire process.
Various tasks that must be done after a loved one passes away include:
  • Paying the deceased's taxes.
  • Paying the deceased’s debts.
  • Collecting the estate assets.
  • Dividing the estate assets between the beneficiaries.
Due to this process being time consuming, exhausting and complicated, we will assist you throughout the entire process.

Probate Litigation

In the event a dispute arises during the course of the administration of an estate, litigation may be necessary. We routinely advise clients in disputes involving a trust or estate, and we are prepared to prosecute or defend cases involving:
  • Will or trust contests
  • Allegations of a breach of fiduciary duty
  • Trust termination and modification proceedings
  • Lawsuits seeking to remove or substitute a trustee or executor
  • Use of Trust and Estate Dispute Resolution Act (TEDRA) to modify or clarify Wills and Trusts
Because disputes and disagreements arise, and may require a resolution in Court, we will take the necessary steps to ensure your best interest.
Guardianship & Conservatorship

If a person is unable to manage his or her financial affairs and medical decisions, a guardian and conservator may be appointed to manage all aspects of that person's affairs. We can help you obtain a guardianship and conservatorship for your elderly family member or for a minor child.  Allow us to help you through this process.
